2The Service
PE Pathway™ provides:
- Access to structured, ability-differentiated PE session content for primary school teachers
- A class marking and pupil assessment system with three differentiated levels: Working Towards, Expected, and Greater Depth
- AI-generated end-of-block and annual report narratives based on class marking data
- A school admin dashboard showing whole-school PE delivery progress
- An Ofsted-aligned reporting tool for PE leads and headteachers
- Safety guidance for each sport, providing risk awareness information for class teachers
PE Pathway reserves the right to update, improve, or modify platform features at any time. Material changes will be communicated to schools by email with reasonable notice.
3Subscriptions and Licences
- Each subscription covers a fixed number of teacher licences as set out at the point of purchase
- Licences are assigned to named staff within a single school
- Licences may not be shared between schools or transferred to a different institution without prior written agreement
- Every active account uses one licence, including the PE lead (School Admin) account
- Annual subscriptions run for 12 months from the start date and renew automatically unless cancelled. The start date is the date of the first card payment or, for schools that pay by invoice, the date shown on the invoice. Monthly subscriptions renew each month until cancelled
- All prices exclude VAT
Current subscription tiers:
| Plan | Monthly | Annual | Licences |
| 1-form entry | £55/mo | £549/yr | 7 licences |
| 2-form entry | £75/mo | £749/yr | 14 licences |
| 3-form entry | £99/mo | £999/yr | 21 licences |
| MAT | POA | POA | Bespoke |
4Licence Reassignment
Teacher licences are assigned to individual accounts but are not permanently tied to a named individual. If a teacher leaves the school, goes on long-term leave, or is otherwise unavailable:
- The licence can be reassigned by the School Admin to a new or covering teacher at any time
- Reassignment does not affect class data — all pupil names, session marks, and assessment history remain attached to the year group
- The outgoing teacher's account is deactivated on reassignment and they immediately lose access to the platform
- A deactivated account cannot be reactivated within the platform, by the teacher or the School Admin. If an account needs to be restored, the School Admin should contact hello@pepathway.co.uk
5Temporary Cover Licences
PE Pathway understands that schools experience unexpected staffing changes during the academic year. To support this, every subscription automatically provides one additional temporary licence whenever it's needed, on the following basis:
- Cover can be set up by the School Admin when a teacher is absent due to maternity leave, long-term illness, or other extended absence, by marking them as on long-term cover and inviting a covering teacher
- The absent teacher's account stops counting towards the school's licence total while cover is in place — their data, class register, and assessment history are fully preserved and they retain no active access to the platform
- The cover teacher receives a standard teacher account linked to the absent teacher's class
- There is no fixed time limit on how long a cover arrangement can run
- Only one teacher may be on cover at any one time under this arrangement. Schools needing to cover a second teacher concurrently should contact hello@pepathway.co.uk
- When the original teacher returns, the School Admin restores their access from the Teachers tab. The covering teacher's account remains active and continues to count towards the licence total until the School Admin separately deactivates it
6Payment
- Schools can pay by card through Stripe. Annual subscriptions are charged in advance; monthly subscriptions are charged at the start of each billing cycle
- Annual subscriptions can also be paid by invoice. Invoices are payable within 30 days of the invoice date. Invoiced subscriptions renew by a new invoice issued before the renewal date. Monthly subscriptions are available by card only
- The PE lead can update the card, download invoices and receipts, and manage a card subscription using Manage Billing on the School Profile tab in PE Pathway
- All prices are exclusive of VAT where applicable
- PE Pathway reserves the right to suspend access if a card payment fails and is not resolved within 30 days, or if an invoice remains unpaid 30 days after its due date. Access is restored once payment is received
- Pricing may be subject to annual review. Schools will be notified of any price changes no less than 60 days before their renewal date
7Acceptable Use
The School agrees to use PE Pathway™ only for legitimate educational purposes within the subscribing school. The School must not:
- Share login credentials between teachers or with individuals outside the school
- Attempt to copy, reverse engineer, or reproduce PE Pathway™ platform content
- Use the platform to store data unrelated to PE assessment
- Attempt to access accounts or data belonging to other schools
- Use the platform in any way that violates applicable law or regulation
8Platform Content
All Platform Content — including session plans, diagrams, vocabulary, progressions, and regressions — is the intellectual property of Fit4Fun Sports Dance & Fitness Limited and is protected by copyright.
The School is granted a non-exclusive, non-transferable licence to access and use Platform Content for internal educational delivery purposes during the active subscription period. This licence does not permit:
- Reproduction or redistribution of Platform Content outside the school
- Use of Platform Content after the subscription has ended or been cancelled
- Sharing Platform Content with competing platforms or third parties
AI-generated report narratives produced by the platform are based on the School's own marking data. Once generated and reviewed, these narratives belong to the School and may be used in school reports without restriction.
9School Data
The School owns all School Data. The School is the data controller and PE Pathway™ is the data processor: PE Pathway processes School Data only to provide the platform and only on the School's instructions.
The Data Processing Agreement forms part of these terms. It sets out how School Data is protected, the providers PE Pathway uses, how AI report comments are produced, and what happens to School Data when the subscription ends. Accepting these terms also accepts the Data Processing Agreement.
How PE Pathway handles personal data more generally is explained in the Privacy Policy.
10Cancellation
10.1 Cancellation by the School
The School may cancel at any time. The PE lead can cancel a card subscription using Manage Billing on the School Profile tab in PE Pathway. Any school, including schools that pay by invoice, can also cancel by emailing hello@pepathway.co.uk.
- Annual plans: cancelling stops the next renewal, or for invoiced plans means no renewal invoice is issued. Access continues until the end of the year already paid for. No refund is given for unused months, except where PE Pathway is at fault, withdraws the service, or under the sub-processor objection process in the Data Processing Agreement
- Monthly plans: cancelling stops the next payment. Access continues until the end of the current month
- When access ends, the School has 30 days to ask for a copy of its School Data, which PE Pathway will provide in a commonly used format such as CSV
- After those 30 days, School Data is permanently deleted, with any backup copies expiring within a further 90 days, as set out in the Data Processing Agreement
- If the School subscribes again after its data has been deleted, it will start with a fresh account and no historical data can be recovered
10.2 Cancellation by PE Pathway
PE Pathway reserves the right to suspend or terminate a school account in the following circumstances:
- Non-payment of subscription fees beyond 30 days of the due date
- Breach of these Terms of Service
- Misuse of the platform or its content
In the event of termination by PE Pathway for reasons other than breach or non-payment, a pro-rata refund will be provided for the remaining subscription period. The School will be given 30 days to request a copy of its School Data before deletion.
PE Pathway will never sell, transfer, or share School Data with any competitor platform or third party, including in the event of cancellation, account closure, or company restructuring.
11Liability
- PE Pathway does not guarantee uninterrupted access to the platform
- PE Pathway is not liable for any loss of data resulting from circumstances outside our control
- PE Pathway's total liability in any 12-month period shall not exceed the annual subscription fee paid by the School
- PE Pathway is not responsible for the content of AI-generated report narratives after they have been reviewed and used by the School
- Nothing in these terms limits any liability that cannot be limited by law
12Governing Law
These Terms of Service are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
